Fin-Tastic Typer ("the Service") is a children's typing and spelling game provided by Hendrik Malan ("we", "us"). By using the Service you are entering into an agreement with Hendrik Malan. By continuing to use the Service you agree to these terms.
Who can use the Service
The game is designed for children aged 4–10 under the supervision of a parent or guardian. Accounts and purchases may only be made by adults (18+) who are legally able to agree to these terms. Parents are responsible for keeping their login details confidential and for activity under their account.
What the Service includes
Easy single-player mode is free. Fin-Tastic Premium is a monthly subscription that unlocks all difficulty levels, Shark Escape and PvP battles.
Acceptable use
You must not misuse the Service, including:
- using it for any unlawful purpose or in breach of any law;
- fraud, spam or impersonation;
- infringing anyone's intellectual property;
- interfering with its security, including introducing malware, probing for weaknesses, scraping, reverse engineering or circumventing access controls;
- reselling or redistributing the Service.
Intellectual property
Hendrik Malan owns the Service and all its intellectual property, including the software, word lists, artwork, characters, documentation and branding. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial use within your plan.
Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, renewal, tax, cancellation and refund terms are governed by Paddle's Buyer Terms. Premium renews automatically each month until cancelled; you can cancel at any time from the Premium page and keep access until the end of the paid period. See our Refund Policy.
Service availability
We work hard to keep the game running, but we do not guarantee that it will be uninterrupted, error-free or always available. To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.
Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability is limited to the fees you paid in the 12 months before the claim. Nothing in these terms limits liability for fraud, death or personal injury where the law does not allow it.
Suspension and termination
We may suspend or end access to the Service for a material breach of these terms, non-payment, fraud or security risk, or repeated or serious violations of our policies. When access ends, account data is deleted in line with our Privacy Notice.
Changes
We may update these terms. Continued use after changes means you accept the new terms.
